Resolution Opposing US DOJ’s Rejection of Non-Partisan Elections in Kinston, North Carolina

Whereas, the citizen’s of the State of North Carolina, have an inherent right to self-government and to choose those who represent them; and

Whereas, the citizens of Kinston, North Carolina voted to change their municipal elections, by nearly 2 to 1, from Partisan to Non-Partisan elections on Nov 4th 2008; and

Whereas, the US Department of Justice, utilizing Section 5 of the Voting Rights Act of 1965, wrongfully overturned a voter-initiated and approved referendum, stating it would “reduce the ability of blacks to elect candidates of choice;” and

Whereas, the measure to enact non-partisan elections passed in seven out of nine city precincts, five out of seven majority-black precincts and only narrowly defeated in the other two majority-black precincts; and

Whereas, the US Department of Justice, violated North Carolina sovereignty and the people of Kinston, North Carolina’s right to self-government through over encroachment of federal power; and

Whereas, non-partisan elections allow for more candidates to choose from on election day, and therefore be in it

Resolved, that the Constitution Party of North Carolina supports the citizens of Kinston, North Carolina to voice their opinion as “We the People” by choosing to conduct their municipal elections in a non-partisan fashion, that the use of Section 5 of the Voting Rights Act of 1965 is, in all cases when used to overturn state or local election laws, an unconstitutional usurpation of State’s Rights and overstepping of federal power as delineated in the United States Constitution, and that the Constitution Party of North Carolina condemns all uses of Section 5 of the Voting Rights Act of 1965 to overturn voter approved election laws.
